Update on New Trademark Registration and Trademark Re-Filings in Myanmar
We have two good news from Myanmar.
New Trademark Registration under the Old Law
We are pleased to report that effective from 1st May 2021 the Registry Office in Yangon has resumed accepting the filings of DTOs for registration of new trademarks under the old law system effective. The Registry Office takes around 2 weeks to approve registration of each DTO.
The Registry Office is also resuming the registration process for the DTOs filed with them before the military coup on 1st February 2021.
Re-filing Registered Trademarks under the New Trademark Law 2019 (“MTL2019”)
We also pleased to report that the re-filing of the registered trademarks and the used trademarks through the WIPO / IPD online filing system under the Order No. 63/2020 of the Ministry of Commerce of Myanmar (“MOC”) continues in full force and effect.
The re-filing period (the Soft Opening Period) will end only on the effective date of the MTL2019 to be announced later by the President of Myanmar.
As of 30th May 2021, around 40,000 registered and used trademarks have been refiled.
The MOC has not yet announced the official filing fees and the form of the official POA.
