MyCC Guidelines on Intellectual Property Rights and Competition Law

With the ever increasing tension between Intellectual Property Rights (“IPR”) and Competition Law, the coming into force of the Guidelines on IPR and Competition Law (“the Guidelines”) is fitting as the Malaysian Competition Commission (“MyCC”) has recognised the need to clarify the dealings and transactions relating to IPRs. The objective of the Guidelines is to address the interaction between competition law and the conduct and/or dealings relating to IPRs.
Through the Guidelines, competition process will be protected with the prevention of anti-competitive agreement and abuse of dominant position involving intellectual property rights. Businesses should refer to the Guidelines to ensure that their IP related agreements are in compliance with Malaysian Competition Law.
