POSITION MARKS: HIGHLIGHTS IN 2023
In view of a year full of updates and changes in the field of Industrial Property in Brazil, 2023 has stood out by new developments and decisions regarding the registration of position marks. In a scenario with an increase of 33.9% (var. % Jan-Oct/2023 when compared to the same period of previous year) in trademark registrations by the Brazilian Patent and Trademark Office (BRPTO), the position mark system has witnessed both grants and decisions which have drawn attention to and been monitored by experts from all over the world.

UPDATES ON BRAZILIAN IP ISSUES – INDUSTRIAL DESIGN
The year 2023 brought many changes to the Brazilian process of industrial design. It started with the adhesion of the Hague Agreement in February 2023.
Further to the adhesion, in July, the BRPTO published Ordinance No. 25/2023, which set forth the registration of industrial designs under the Hague Agreement.

UPDATES ON BRAZILIAN IP ISSUES – GEOGRAPHICAL INDICATION
2023 was marked by several recognitions of Geographical Indications (GIs) by the Brazilian PTO. GIs play an important role in the economic development of a country, making it necessary to disseminate this “form of protection” to add value to products and services from a given region.
