2ND EDITION OF THE INDUSTRIAL DESIGNS MANUAL PRESENTS NEW RULES FOR REGISTRATION IN BRAZIL
At the beginning of October, the 2nd edition of the Industrial Designs Manual came into force. It is important to note that this edition of the Manual comes at an opportune time, as Brazil recently joined the Hague System for the International Registration of Industrial Designs (ID). This new edition brings harmonization of the ID Manual with the Guidelines of the Hague System.
LOUBOUTIN’S POSITION MARK IN BRAZIL – BRPTO’S REJECTION DECISION IS SUSPENDED
Louboutin's attempt to register the red sole of its shoes as a position mark before the BRPTO has become one of this year’s most prominent legal cases in Brazil. Recently, Judge Marcia Maria Nunes de Barros issued an injunction suspending the previous decision from the BRPTO, which rejected Louboutin’s application to protect the the red sole as a position mark.
FEDERAL REGIONAL COURT OF THE 2ND REGION GRANTS APPEALS FOR DIVISIONAL PATENT APPLICATIONS
The Federal Regional Court of the 2nd Region recently granted two appeals, from the same owner, reversing BRPTO’s decisions that shelved divisional applications filed in the appellate level of the parent application, due to the joint interpretation of the caput of art. 26 of Law No. 9.279/96 and art. 32 of Normative Instruction No. 30/2013.
