As of May 2024, it is not possible to file patent applications in Myanmar. The intellectual property (IP) landscape in Myanmar is undergoing significant transformations. KENFOX IP & Law Office anticipates the following key changes in IP protection in Myanmar:
[i] Trademark law modernization:
- First-to-File system: Myanmar's new first-to-file trademark registration system, effective since April 26, 2023, replaces outdated colonial-era laws. This provides a more comprehensive framework for trademark protection, aligning Myanmar with other Southeast Asian nations like Thailand and Vietnam.
- Increased protection: The new Trademark Law offers enhanced protection for brand owners, encouraging innovation and investment. This law includes streamlined filing procedures and mechanisms for opposition and appeals within specified time frames.
[ii] Implementation of Industrial Design and Copyright laws:
- Full implementation: The Industrial Design Law and Copyright Law, both enacted in 2019, came into full effect in October 2023. These laws provide robust protection mechanisms under a structured framework, ensuring comprehensive rights for owners.
- Boosting foreign investment: The modernized legal framework is expected to attract increased foreign investment by providing more reliable IP protection.
[iii] Government administration and supervision
The Ministry of Commerce administers the new Trademark Law, with supervisory roles from the Ministries of Information, Industry, Agriculture, Livestock and Irrigation, and Education. This multi-ministry involvement ensures thorough implementation and oversight.
