Established in 2010, KENFOX IP & Law Office has swiftly become one of the region’s most esteemed IP firms, recognized for its unwavering commitment to excellence and client satisfaction.

Our team of highly skilled attorneys and IP experts brings extensive experience and specialized knowledge to every case, ensuring that your IPRs are robustly protected and strategically managed. We pride ourselves on offering comprehensive IP services tailored to meet the unique needs of businesses operating in Myanmar.

Despite the patchy state of IP protection in Myanmar, we have successfully assisted various multinational companies in registering and protecting their rights with the Myanmar IP Office. While trademarks have been fairly well protected through a combination of common law principles, criminal law, and established practice, other forms of IP often receive less protection. As of May 2024, it is not possible to file patent applications in Myanmar. Our profound understanding of the local IP landscape, coupled with our proactive and innovative approach, enables us to deliver effective solutions that safeguard our clients’ intellectual assets and support their business growth.

With over a decade of litigation experience, KENFOX IP & Law Office has cultivated strong relationships with various governing bodies in Myanmar, enabling us to effectively assist clients in the protection of their IPRs. We have a proven track record of collaborating with law enforcement agencies and police investigators to conduct raids, resulting in the seizure of hundreds of thousands of counterfeit products.

At KENFOX IP & Law Office, you will find the expertise, experience, and professionals required to handle all aspects of law, both domestically and internationally. We are the trusted partner of many multinational and international enterprises, assisting them in developing strategic decisions and securing their interests in Vietnam, Laos, Cambodia, and Myanmar.

Our firm is highly regarded for its strong reputation in IP and litigation. Our attorneys are distinguished by their extensive experience and success in assisting leading international and domestic corporations with IP prosecution and enforcement in Vietnam, Laos, Cambodia, Myanmar, and beyond.

2. What emerging trends do you foresee in the IP landscape in Myanmar over the next 12 months, and what factors are driving these changes?

The intellectual property (IP) landscape in Myanmar is undergoing significant transformations. KENFOX IP & Law Office anticipates the following key changes in IP protection in Myanmar:

[i] Trademark law modernization:

  • First-to-File system: Myanmar's new first-to-file trademark registration system, effective since April 26, 2023, replaces outdated colonial-era laws. This provides a more comprehensive framework for trademark protection, aligning Myanmar with other Southeast Asian nations like Thailand and Vietnam.
  • Increased protection: The new Trademark Law offers enhanced protection for brand owners, encouraging innovation and investment. This law includes streamlined filing procedures and mechanisms for opposition and appeals within specified time frames.

[ii] Implementation of Industrial Design and Copyright laws:

  • Full implementation: The Industrial Design Law and Copyright Law, both enacted in 2019, came into full effect in October 2023. These laws provide robust protection mechanisms under a structured framework, ensuring comprehensive rights for owners.
  • Boosting foreign investment: The modernized legal framework is expected to attract increased foreign investment by providing more reliable IP protection.

[iii] Government administration and supervision

The Ministry of Commerce administers the new Trademark Law, with supervisory roles from the Ministries of Information, Industry, Agriculture, Livestock and Irrigation, and Education. This multi-ministry involvement ensures thorough implementation and oversight.

Myanmar’s IP landscape is evolving rapidly due to legal reforms, increased protection mechanisms, and efforts to align with regional standards. Businesses operating in Myanmar should stay informed about these changes and leverage the improved IP protection to safeguard their interests and foster growth.
