The intellectual property (IP) landscape in Cambodia is poised for significant evolution over the next 12 months, driven by a combination of governmental initiatives, policy enhancements, and efforts to address historical IP challenges. KENFOX IP & Law Office anticipates the following key changes in IP protection in Cambodia:


[i] Enhanced ip protection and streamlined registration processes: The finalization of the Draft IP Policy 2023-28 by the National Committee for Intellectual Property Rights (NCIPR) is set to guide IP-related decisions and strategies in Cambodia for the coming years. This policy aims to enhance IP protection, streamline registration processes, and promote innovation. As the policy is implemented, we can expect a more robust IP framework that facilitates easier and faster registration of IP rights, providing greater security for IP holders.


[ii] Strengthening IP enforcement: Cambodian officials have been working diligently to enhance the country’s IP regime. This commitment to improvement is likely to continue, leading to more robust IP protection and enforcement. The government’s focus on addressing the past reputation of IP infringement, particularly in areas like film, music, and dubbing, will drive stricter enforcement measures and more rigorous compliance with IP laws.


[iii] Growth in patent applications and utility models: Cambodia has shown a notable increase in patent applications and utility models. In 2022, the country ranked 41st globally for patent applications, with a significant 720% growth in abroad applications. Utility model applications also saw an 85.7% increase. The dominant technical fields include electrical machinery, apparatus, and energy, which account for 50% of patent applications. This growth reflects a rising interest in protecting innovations and technological advancements.


[iv] Increased participation in the patent cooperation treaty (PCT): Cambodia's participation in the Patent Cooperation Treaty (PCT) has seen remarkable growth. PCT national phase entries increased by 3200%, and the share of abroad applications using the PCT system is 80.5%. This indicates that Cambodian innovators are increasingly seeking international patent protection, highlighting the country's integration into the global IP landscape and its commitment to aligning with international standards.
