Landmark cases
In one of the DNI’s most notable landmark case took place in 2011, DNI represented Samsung Electronics Co., Ltd. against Vietnamese cybersquatting companies and individuals. DNI successfully won the case for Samsung – the first domain name lawsuit in Vietnam as well as a milestone in the history of the Vietnamese judicial system for the enforcement of IP and IT laws.
In another remarkable case which is the first administrative commercial lawsuit relating to a trademark dispute against the Vietnam Ministry of Science and Technology in 2014, DNI represented Malco Products Inc. and obtained a favourable outcome for the client.
More recently, in 2018, DNI, representing National Nail Corp., a US screw manufacturer, successfully opposed a patent application for “screw” invention filed by a Taiwanese screw manufacturer through a lawsuit before the Court. This is one of the very few cases in relation to patents and the first lawsuit over the right to register patents that was ever settled in Vietnam. With our strong arguments against the registration in bad faith of the Taiwan screw manufacturer, the Court rendered a judgment announcing that the Defendant did not have the right to register the patent application in Vietnam.
